1. About this Application

WhatsApp Marketing Platform is an internal marketing communication tool built by Fleming Embedded and Software Solutions for its own internal business purposes. The Application is not a public product and is not offered for sale or open use by the general public.

Access to the Application is restricted to authorized employees and designated personnel of Fleming Embedded and Software Solutions. Accounts are created only through the company’s official registration process or by an authorized administrator.

The Application enables authorised users to plan and send marketing messages using messaging templates made available through the MSG91 gateway (www.msg91.com).

2. Acceptance of Terms

By registering, logging in, or continuing to use the Application, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and our Privacy Policy.

3. Eligibility and Access

• Only authorised personnel of Fleming Embedded and Software Solutions may access the Application.
• Access credentials are provided on a need-to-know basis and must not be shared.
• The Application is intended for users aged 18 and above who are associated with the company.

4. Account Registration and Security

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your username, password, and mobile device.
• You must notify the administrator immediately of any unauthorised use of your account.
• Accounts may be suspended or deleted if they are misused or left inactive.

5. Acceptable Use

When using the Application you agree that you will not:

• Send unsolicited, bulk, or spam messages to any recipient.
• Use the Application for any illegal, fraudulent, or harmful purpose.
• Send messages without the required consent of the recipient where consent is required by law.
• Misuse MSG91 templates, brand names, or content that you are not authorised to use.
• Attempt to access another user’s account or data.
• Tamper with, reverse engineer, or disrupt the Application or its services.

6. Use of MSG91 Messaging Templates

WhatsApp Marketing Platform sends messages through the MSG91 messaging gateway using approved marketing templates. You agree that:

• Messages will only be sent for genuine marketing purposes of the company.
• Template content will be accurate, not misleading, and not deceptive.
• Recipients who opt out must be honoured promptly.
• All usage will comply with MSG91’s terms of service and applicable regulations.

7. Intellectual Property

The Application, its design, software, content, and related materials are the property of Fleming Embedded and Software Solutions. You may not copy, distribute, modify, or create derivative works without prior written consent.

8. Privacy and Data

Your personal information is handled as described in our Privacy Policy. By using the Application you consent to the collection and processing of data as described therein.

9. Limitation of Liability

The Application is provided on an “as is” and “as available” basis for internal use. To the maximum extent permitted by law, Fleming Embedded and Software Solutions shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Application, including failed message delivery or service interruptions.

10. Termination

We may suspend or terminate your access to the Application at any time, with or without notice, if you breach these Terms or for internal security or compliance reasons.

11. Changes to these Terms

We may update these Terms & Conditions from time to time. Updated Terms will be effective when published on this page. Continued use of the Application after changes constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala.
